The case was brought in the United States District Court for the Eastern District of Pennsylvania and is based on Pfizer's "Patent Act" patent, covering the formulation of Nexium. The patent claims that "Nexium is a prescription drug which is effective and safe for use in the treatment of heartburn (indicated by the presence of acid in the stomach). The patent does not disclose a way to limit the dosage of Nexium that is effective or safe for use in the treatment of heartburn." The case was filed in the United States District Court for the Eastern District of Pennsylvania. The suit was brought in two United States District Courts, the United States District Court for the Eastern District of Pennsylvania and the District of Columbia. The suit has been settled by Pfizer's U. S. District Court Judge John G. Schiller. The defendant has provided evidence and evidence of his successful prosecution of the suit.
